Acceptable Use Policy (AUP)

This Acceptable Use Policy (“AUP”) governs all use of products and services provided by TrustedHosting.in (“Company”, “we”, “our”, or “us”). By using or continuing to use our services, the customer (“you”, “your”, or “client”) agrees to comply with this policy and all related laws, regulations, and contractual obligations. Violation of this AUP may result in suspension, termination, or legal action without prior notice.

1. Purpose of the Policy

The purpose of this AUP is to ensure that our network, servers, and infrastructure remain secure, stable, and accessible to all customers. This policy sets out prohibited activities, security expectations, and guidelines for responsible use of all hosting, reseller, VPS, dedicated, and cybersecurity services offered by TrustedHosting.in.

2. Responsible Usage Commitment

Customers agree to use the services in a lawful, ethical, and responsible manner. Activities that may harm the integrity of our network, reputation, or third-party systems are strictly prohibited. Each client is responsible for the content they host, transmit, or distribute using our infrastructure.

3. Prohibited Activities

The following activities are expressly forbidden across all TrustedHosting.in platforms and servers:

  • Hosting, distributing, or linking to any content that is illegal under Indian law or international law, including but not limited to child exploitation, terrorism, fraud, or defamation.
  • Transmission of unsolicited bulk email (“spam”) or engaging in mass email marketing without prior opt-in consent of recipients.
  • Phishing, spoofing, impersonation, or use of deceptive domains intended to mislead recipients or harvest credentials.
  • Hosting or distributing malware, trojans, keyloggers, ransomware, or any malicious software.
  • Participating in or facilitating denial-of-service (DDoS), port scanning, brute-force attacks, or unauthorized penetration testing.
  • Hosting cracked software, nulled scripts, pirated content, or distributing copyrighted material without proper licensing.
  • Operating proxy networks, VPN relays, or anonymization services without prior written authorization from TrustedHosting.in.
  • Hosting of hate speech, extremist propaganda, incitement to violence, or harassment targeting individuals, religions, or communities.
  • Running mining software (cryptocurrency mining, GPU/CPU miners) or resource-intensive daemons on shared or reseller environments.

4. Network and Server Security

Customers must not attempt to compromise or disrupt the security, stability, or performance of any server, network, or application belonging to TrustedHosting.in or other clients. Any detected intrusion attempts, port scans, or privilege escalation actions will lead to immediate termination and may be reported to law enforcement or CERT-In.

5. Spam and Email Abuse

TrustedHosting.in enforces a zero-tolerance policy on spam and bulk mailing. Sending unsolicited emails, purchasing mailing lists, or using scripts to automate mass delivery is strictly prohibited. Accounts found sending spam will be immediately suspended. Outbound mail rate limits apply to protect server reputation and global RBL standing.

6. Resource Abuse and Fair Usage

Shared and reseller hosting environments operate on a resource-shared model. Excessive CPU, memory, disk I/O, or process usage that degrades performance for other users will result in warnings or restrictions. Continuous abuse may result in migration to a higher-tier plan or account suspension. Background daemons, crypto miners, and continuous crawler bots are disallowed on shared plans.

7. Reseller and Alpha Reseller Responsibilities

Resellers are fully responsible for the activities of their downstream users. Any violation of this AUP by end users is considered a violation by the reseller. Resellers must ensure sub-clients adhere to the same security, content, and spam guidelines defined in this policy. Alpha resellers must maintain accurate licensing usage and report abuse promptly.

8. Cybersecurity and Penetration Testing Activities

Security assessments, vulnerability scans, or penetration tests against any infrastructure (including those owned by customers) require prior written authorization. Unauthorized testing against any target or network using our servers constitutes a breach of the Computer Misuse and IT Act (2000) and will be treated as a criminal offense.

9. Illegal or Unethical Use

Customers may not use our infrastructure to store, share, or promote illegal, obscene, defamatory, or fraudulent content. This includes phishing kits, fake login pages, unlicensed software repositories, gambling operations (unless legally permitted), and counterfeit product distribution.

10. Copyright and Intellectual Property

All hosted content must comply with applicable intellectual property laws. Hosting or linking to pirated movies, software, games, or copyrighted works without proper authorization will result in content removal and account suspension. TrustedHosting.in will act upon valid DMCA or copyright infringement notices.

11. Phishing and Fraudulent Sites

Any website impersonating another brand, collecting sensitive data without consent, or designed for fraud will be removed immediately upon detection. Customer data may be preserved and shared with law enforcement for investigation under applicable cybercrime laws.

12. Offensive or Hateful Content

Hosting content that promotes hate speech, racial discrimination, religious intolerance, or personal harassment is prohibited. TrustedHosting.in reserves the right to suspend or terminate such accounts at its sole discretion without refund.

13. Privacy and Data Handling

Clients are responsible for ensuring that their websites comply with privacy regulations applicable to their audience. Personally identifiable information (PII) must be collected and processed lawfully, and users must be informed of how their data is used. Misuse of personal data will be treated as a serious breach of this policy.

14. Use of Scripts and Applications

All scripts, plugins, and applications installed on our servers must be kept updated and free from known vulnerabilities. Outdated or insecure code that threatens server stability may be disabled. Auto-installers (e.g., Softaculous) are provided for convenience but customers remain responsible for maintenance.

15. Email Sending Limits and SMTP Usage

For shared and reseller accounts, outbound emails are limited to prevent abuse and maintain IP reputation. Sending limits vary per plan and may be modified to maintain network hygiene. Use of external SMTP relay services must comply with anti-spam policies and authentication standards (SPF, DKIM, DMARC).

16. Enforcement and Investigation

TrustedHosting.in actively monitors server activity to maintain uptime and security. Upon receiving abuse reports or detecting suspicious activity, we may investigate account data, log files, or network behavior. Failure to cooperate during investigations may lead to suspension or data preservation under legal mandate.

17. Suspension and Termination

Accounts violating this policy may be suspended or terminated without prior notice. In severe cases, services may be disabled immediately to prevent harm to the network or third parties. Repeated or intentional abuse will result in permanent account closure and denial of future services. No refunds will be issued for terminated accounts.

18. Reporting Violations

Suspected violations of this AUP should be reported to abuse@trustedhosting.in with full details, including domain name, logs, timestamps, and evidence. Our security team reviews each report promptly and takes appropriate action per our escalation matrix.

19. Law Enforcement Cooperation

TrustedHosting.in fully cooperates with legitimate law enforcement requests, government agencies, and CERT-In authorities for cybersecurity or criminal investigations. Data may be preserved or shared when legally mandated. Customers are notified where permitted by law.

20. Amendments and Modifications

This Acceptable Use Policy may be updated periodically to reflect evolving security, compliance, and operational standards. The latest version will always be published on our website. Continued use of services after such updates constitutes acceptance of the modified terms.

21. Governing Law

This AUP shall be governed by and construed in accordance with the laws of India. Any disputes arising under this policy will be subject to the exclusive jurisdiction of the courts in Krishna District, Andhra Pradesh, India.
